مشكلة الدراسة: هناك مؤشرات داخل المجتمع السوري تنذر بتحول الهجرة غير القانونية من حالات فردية لا تشكل عبئاً على المجتمع إلى جريمة نمطية, يصعب السيطرة عليها وقمعها. إن سوء الأوضاع الاقتصادية المتمثلة في ارتفاع معدلات البطالة وتزايد نسبة الفقر والتضخم في مقدمة تلك المؤشرات. كما أن عدم الاستقرار السياسي والأمني الذي تشهده البلاد حالياً يزيد من احتمالات تزايد الهجرة غير القانونية من سورية. إضافة إلى عدم وجود إستراتيجية وطنية لمواجهة الهجرة غير القانونية من سورية.
أهمية الدراسة: تنبثق أهمية الدراسة انطلاقاً من ضرورة مواجهة الهجرة غير القانونية من سورية درءاً للآثار السلبية المترتبة عليها والمؤثرة على الفرد والمجتمع الدولة.
أهداف الدراسة: تهدف الدراسة إلى التعريف بواقع الهجرة غير القانونية في سورية, وتوضيح عوامل تناميها في المجتمع والآثار المترتبة عليها, والنظر المعمق في التجربة السورية المعنية بمواجهة تلك الهجرة وتقييمها وصولاً إلى بناء تصور إستراتيجي متكامل يهدف إلى مواجهة هذا النوع المتنامي من الهجرات .
منهج الدراسة: اعتمد في الدراسة على منهج متكامل يمزج بين طياته عدد من الطرائق العلمية الطريقة التاريخية والوصفية التحليلية والقانونية والطريقة المقارنة وعدد من الأساليب والأدوات البحثية بخاصة الأسلوب الإحصائي وأداة التحليل الإستراتيجي "Swot".
أهم النتائج:
1- عدم وجود إستراتيجية وطنية تعنى بمواجهة الهجرة غير القانونية في الجمهورية العربية السورية.
2- عدم وجود قانون خاص يجرِّم تلك الهجرة, واقتصار التجريم على الأفعال المتصلة بها من خلال عدد من القوانين والمراسيم التشريعية.
3- عدم وجود إدارة متخصصة في وزارة الداخلية تعنى بمواجهة الهجرة غير القانونية في سورية.
4- الافتقاد إلى الدراسات والبحوث الميدانية التي تعنى بدراسة الهجرة غير القانونية بصورة علمية شاملة, إذ ليس هناك مراكز دراسات وبحوث للقيام بتلك المهمة.
أهم التوصيات:
1- ينبغي وضع إستراتيجية وطنية لمواجهة الهجرة غير القانونية في سورية تنطلق من التنمية الشاملة, ومكافحة البطالة والفقر وخلق فرص عمل للشباب.
2- تسريع إصدار تشريع وطني سوري متكامل خاص بتجريم الهجرة غير القانونية في سورية.
3- إنشاء إدارة متخصصة تتبع وزارة الداخلية السورية تعنى بمكافحة هذه الحالة المتنامية.
4- الاهتمام بتشجيع البحوث والدراسات العلمية والميدانية عن هذه الهجرة بخاصة بين الشباب السوري, ولعل إنشاء مركز للبحوث والدراسات الأمنية يسهم بشكل فعال في معالجة هذه الظاهرة بطرق علمية.

Study Content: It lies in the presence of indicators within Syrian society warning of converting illegal migration from individual cases that do not constitute a burden on the community to typical crime which is difficult to control and suppress ; The poor economic conditions in terms of high unemployment , increasing poverty and inflation are in the forefront of those indicators , The lack of political and security stability in Syria increase cases of illegal immigration from Syria, in addition to the lack of a national strategy to face illegal immigration in Syria.
Study Importance: The importance of this study stems from the need to face illegal immigration from Syria in order to avoid the effects of which on individual or community or state.
Study Purposes: They are reflected in the definition of illegal immigration in Syria, and to clarify the factors of increasing it in society and their implications, and to identify the Syrian experience in the field of facing illegal immigration and evaluate it to reach a strategic vision to face it in Syria.
Study Thesis: It's been relying on an integrated approach that contains a number of academic methods (the historical method - descriptive analytical method - legal method - Comparative method), and a number of research methods and tools (statistical method - Strategic Analysis Tool "Swot").
Main Results:
1 – The absence of a national strategy that concerned with illegal immigration in Arab Republic of Syria.
2 - The absence of a specific law that criminalizing illegal immigration in Syria, and limiting of the criminalization on acts related to illegal immigration through several laws and legislative decrees.
3 – The absence of a specialized department at the Interior Ministry that concerned with facing illegal immigration in Syria.
4 - Lack of studies and field research concerned with the study of illegal immigration, and the lack of studies and research centers to carry out that task.
Main Recommendations:
1 - The need to adopt a national strategy to face illegal immigration in Syria based on the foundations of human development, the fight against unemployment, poverty and creates jobs for young people.
2 - Speed up the issuance of a Syrian national integrated legislation related to criminalization of illegal immigration in Syria.
3 - The establishment of a specialized department to face illegal immigration and following the Syrian Interior Ministry.
4 - Interest in encouraging research and scientific and field studies for the migration of young Syrian, the emphasis on the establishment of research centers and Security Studies and deepen scientific role in the study and analysis of criminal and social phenomena.
