Summary, etc. مشكلة الدراسة: تكمن مشكلة الدراسة في السؤال الرئيسي التالي: هل التضليل الإعلامي جريمة قانونية تستوجب المساءلة الجنائية ؟<br/>أهداف الدراسة: تهدف هذه الدراسة إلى: تحديد المقصود بجريمة التضليل الإعلامي، وبيان خطورتها على أمن المجتمع وسلامته، والأساليب المستخدمة في التضليل الإعلامي، وتوضيح موقف الإسلام والقانون من جريمة التضليل الإعلامي، وتحديد المسؤول عنها جنائيًّا، وذكر النصوص القانونية الواردة بشأن هذه الجريمة.<br/>منهج الدراسة وأدواتها: اعتمد الباحث في هذا البحث على المنهج التأصيلي منهجًا أساسيًّا، في تأصيله لتجريم التضليل الإعلامي في الفقه الإسلامي وأنظمة الحكم في المملكة العربية السعودية، كما استخدم المنهج الوصفي الذي يقوم على وصف مفاهيم التضليل الإعلامي، ثم وصف أشكاله، وأساليبه.<br/>أهم النتائج:<br/>1- الإعلام ليس مجرد وسيلة لمعرفة الأخبار فحسب؛ فالوظائف المتعددة للإعلام تجعله قوة مؤثرة في العديد من أوجه النشاط الأخرى: الاجتماعية، والثقافية، والتربوية، والسياسية، وغيرها، وقوة متفاعلة تؤثر وتتأثر بهذه الأنشطة والقضايا المختلفة.<br/>2- إذا كان لحرية الرأي لها دور كبير في تقدم المجتمع؛ فإن الحرية المطلقة المتحررة من أي قيد، تفتح الباب للتضليل الإعلامي.<br/>3- المقصود بجريمة التضليل الإعلامي: تضليل الرأي العام عبر وسائل الإعلام المختلفة عن طريق عدمتقيد الإعلام بضوابطالعمليةالإعلامية، وتعمد الامتناع عن نشر الحقيقة في موضوع معين، أو تعمد إخفاء جانب منها، أو استخدام أحد أشكال التضليل الإعلامي عند تناول الأخبار.<br/>4- التضليلالإعلامي جريمةجنائية، لها ثلاثة أركان:الركن الشرعي، والركن المادي، والركن المعنوي.<br/>5- هناك عدة صعوبات قانونية في تحديد الأشخاص المسؤولين عن ارتكاب جريمة التضليل الإعلامي.<br/>أهم التوصيات:<br/>1- أنيأخذموضوع التضليل الإعلامي عناية أكثرمنقبلالباحثين؛ بحيث يتم توعية الجماهير بخطورته، وأساليبه، وأشكاله المختلفة.<br/>2- أن تتضمن المواد القانونية المكونة لنظام الحكم في المملكة موادًّا قانونية صريحة النص على أن التضليل الإعلامي جريمة قانونية.<br/>3- أن يحدد القانون بصورة أكثر وضوحًا المسؤول جنائيًّا عن هذه الجريمة، وطرق رفع الدعوى فيها.<br/>4- حث وسائل الاتصال الجماهيري على الالتزام بضوابط العمل الإعلامي، وما جاء في مواثيق الشرف الإعلامي، وعدم مخالفة هذه المواثيق.<br/>5- جعل مواقع التواصل الاجتماعي وسيلة لنشر المعارف الكونية والعلوم الإنسانية، مع مراعاة خصوصيات الشريعة الإسلامية.
Summary, etc. Study problem: the study problem is in the following question:Is media disinformation crime had legal interrogation ?<br/>Study Objectives:The present study seeks to cherish following objectives: Identify the intended disinformation media, and clarify the seriousness of it .And explain the media disinformation tools in detail, With explain the position of Islam from media disinformation.And Present tip and recommendations of laws to criminalize disinformation, and in which chapter could be incorporate those laws.<br/>study methodology:The researcher in this research adopted thefundamentalist approach to criminalize disinformation in Islam and the regimes in Saudi Arabia. And he used the descriptive approach ,which describe the concepts of media disinformation, its forms , methods and the law opinion about that crime.<br/>Main results :<br/>1- Media is not just away to see only the news, it has multiple functions makes a powerful force in many other activities; social, cultural, educational, political and other.And interactive power which affect and affected by these activities and the various issues.<br/>2- If freedom of opinion played amajor role in the progress of society, so that absolute freedom open the door for the media disinformation.<br/>3- Disinformation crime is :mislead the public opinion through the different media by refrain from publishing the truth about a certain topic or using disinformation methods when they addressing the news.<br/>4- Media disinformation crime is criminal offense, has three bases , the legal basis, material basis ,and moral basis.<br/>5- There are several legal difficulties individuals officials for thedisinformation crime, because of the large number in the preparationand publication. <br/>The recommendations:<br/>1- Take the subject of media disinformation more attention by researchers,and educating people about seriousness,forms and various methods.<br/>2- Thelawsystem of government in the kingdom must includes legal materials that considered media disinformation legal crime.<br/>3- The law defines more clearly criminally liably for the crime ,and ways to suit the crime. <br/>4- Encourage the methods of the public media to compliance with the controls media work.<br/>Making social networking sites away to spread the knowledge of cosmic and human sciences, taking into account the specificities Islamic law.
