مشكلة البحث : بالرغم من الأهمية والفوائد التي تجلبها التجارب الطبية التي شهدت في السنوات الأخيرة انتشاراً كبيراً في المجتمعات ورافق هذا التوسع زيادة المشاكل والمخاطر التي تهدد حياة البشر مما أوجد وجهاً للمسئولية تتواكب معها حيث إن القائمين عليها قد لا يتوفر أو يتضح لهم نطاق الإباحة مما نتج عنه كثير من الانتهاكات الخطيرة ولذا نشاهد كثرة القضايا الخاصة بالأخطاء والتجارب الطبية في أروقة المحاكم سواء الجنائية أو المدنية. وبناءً عليه فإن مشكلة الدراسة تتجسد في السؤال الرئيس التالي :ما أحكام المسؤولية الجنائية عن التجارب الطبية على الإنسان ؟
أهمية الدراسة : بيان وتوضيح أحكام التجارب الطبية في الجانب الشرعي واستيعاب المشكلات الناتجة عنها وما يستجد من تجارب علمية حديثة على الإنسان والقيام بضبط أحكامها بالضوابط الشرعية، ما يمثل إضافة علمية للمكتبة العربية .
منهج الدراسة : نظراً لطبيعة هذه الدراسة فقد اعتمدت على المنهج الوصفي التحليلي
نتائج الدراسة :
- إن أي اعتداء يمس جسم الإنسان بكل أعضائه ظاهرة وباطنة يمثل جريمة يتحمل القائم بها المسؤولية الجنائية،ويعاقب عليها طبقاً لأحكام النظام .
- تتطور الأبحاث الطبية في مجال التجارب الطبية والعلمية على جسم الإنسان بصورة سريعة متواكبة مع التطور الطبي والتقني الذين يشهدهما العصر الحاضر.
- دلت الشريعة الإسلامية وكذلك فعل الصحابة رضوان الله عليهم على مشروعية التجارب الطبية والعلمية على الإنسان ولكن بشرط أسبقية تطبيقها على الحيوان وفي المختبرات
التوصيات : توصي الدراسة بما يلي :
- ضرورة تخصيص لجنة لتوعية الإنسان بآثار التجربة وعواقبها والتأكد من الرضا الكامل الحر منه بإجراء التجربة , ويشترط لهذه اللجنة ألا تضم أحداً من أفراد الطاقم الطبي المكلف بإجراء التجربة .
- عدم إعفاء مراكز الأبحاث من الأخطاء الطبية سواء أكانت جسيمة أو يسيره فنية أو غير فنية , وذلك بجانب مساءلة الطبيب جنائياً أو مساءلة مساعديه أو الممرضين .
- ضرورة الرقابة الشديدة والمستمرة على مراكز الأبحاث للتأكد من مطابقة الأطباء للشروط التي وضعها النظام السعودي لمزاولة المهنة.

Study Problem: Despite the importance and the benefits that brings medical experiments that seen in recent years is widespread in communities and accompanied this expansion increase the problems and risks to human life, creating a face of the responsibility to keep pace with them as those who made it may not be available or clear them within permissible resulting in many serious violations and so we see the large number of issues concerning medical mistakes and experiences in the courts, either criminal or civil. Accordingly, the problem of the study is embodied in the following main question: What provisions of criminal responsibility for medical experiments on?

The Important of the study: Statement and clarify the provisions of medical experiments in the forensic side and absorb the resulting problems and new modern scientific experiments on humans and to adjust its provisions legitimacy controls, represents a scientific addition to the Arab library
Study Methodology: Due to the nature of this study has adopted the descriptive analytical method
The most important results of the study:
-If any Assault that affects the human body in all its members phenomenon and Internists represents a crime based bear criminal responsibility, and punishable under the Penal Code.
- Develop medical research in the field of medical and scientific experiments on the human body rapidly parallel with the development of medical and technical who Ishdahma the present era.
- Indicated by Islamic law and so did the prophet, God bless them on the legality of medical and scientific experiments on humans, but only applied to the precedence in laboratory animal
The most important recommendations:
- The need to allocate a committee to raise awareness of human effects of the experiment and its consequences and to ensure full satisfaction of the free him to conduct the experiment, and in order for this committee not include anyone from medical personnel to conduct the experiment.
- Non-exempt research centers of medical errors, whether serious or driven by technical or non-technical, and next to criminally accountable doctor or accountability or nurses aides.
- The need for strict control and ongoing research centers to ensure conformity of doctors to the conditions set by the Saudi regime to practice.
