Abdullah Mohammad Rababah Research Problem : The problem of the study by answering the key question : What controls the work of civilian private security guards in the Saudi Regime? Study Objectives : The study aims to reflect the reality of the guard in Islamic jurisprudence, and the relevant authorities to activate the civilian private security guard in Saudi regime and its tasks and requirements in the Saudi regime, And the rights of workers in Islamic jurisprudence and the Saudi regime, and the penalty breach their contracts and work in Islamic jurisprudence and the Saudi regime? Research Methodology: The study was based on a descriptive style approach based on induction and analysis. main Results: 1. The Private Guard to own a legitimate origin in the Quran and Sunnah and consensus. 2. The fact that private security existed since the era of the Prophet and his companions, God bless them, and advances the common good follower , and lasted until the present era. 3. That the system of civilian private security guards and its implementing regulations do not violate what came by Islamic law in this area. 4. That the system of private security guards and its implementing regulations did not provide for the rights of their some employees, With regard to the identification and functional staff them, and the minimum salary, and health and social care, and their insurance of injuries and hazards. 5. That the system of civilian private security guards and its implementing regulations did not provide for the role of the Ministry of Municipal and Rural Affairs Although the licenses are issued, including those binding. 6. That the system of civilian private security guards and its implementing regulations did not include a clear definition of penalties offending agent guard and his relations with the employer, and the beneficiaries. Main Recommendations: 1. Support the management of civilian private security guards and the condition of its people in areas of the possibilities of human and material resources. 2. Reconsider the amendment of some articles of the civilian private security guards and the Regulations, to include the rights of workers, to determine the salaries and the creation of a cadre functional, and health and social care, and to identify the minimum salary. 3. Reconsider the system of civilian private security guards and its executive to find an effective role of the Ministry of Municipal and Rural Affairs in this area. 4. Reconsider the system of civilian private security guards and its executive to find an effective role of the Ministry of Municipal and Rural Affairs in this area. 520			_aمشكلة الدراسة : تكمن مشكلة الدراسة من خلال الإجابة على السؤال الرئيس : ما ضوابط عمل الحراسات الأمنية المدنية الخاصة في النظام السعودي ؟ أهداف الدراسة : تهدف الدراسة إلى بيان التأصيل الفقهي للحراسة في الفقه الإسلامي ، والجهات ذات العلاقة بتفعيل الحراسة الأمنية المدنية الخاصة في النظام السعودي ، ومهامها ومتطلباتها ، وحقوق العاملين فيها ، وعقوبة الإخلال بعقودها وأعمالها في الفقه الإسلامي والنظام السعودي . منهج الدراسة : قامت الدراسة على المنهج الوصفي بطريقته العلمية القائمة على الاستقراء والتحليل . أهم النتائج : 1/ للحراسة الخاصة أصل شرعي في الكتاب والسنة والإجماع . 2/ إن حقيقة الحراسة الخاصة موجودة منذ العهد النبوي وعهد الصحابة رضي الله عنهم والسلف الصالح ، وامتدت حتى عصرنا الحاضر. 3/ إن نظام الحراسات الأمنية المدنية الخاصة ولائحته التنفيذية لا يخالف ما جاءت به الشريعة الإسلامية في هذا المجال . 4/ لم ينص نظام الحراسات الأمنية الخاصة ولائحته التنفيذية على بعض حقوق العاملين فيها ، فيما يتعلق بتحديد الكادر الوظيفي لهم، والحد الأدنى لرواتبهم ، والرعاية الصحية والاجتماعية لهم ، وتأمينهم من الإصابات والأخطار . 5/ لم ينص نظام الحراسات الأمنية المدنية الخاصة ولائحته التنفيذية على دور وزارة البلدية والشئون القروية في هذا المجال رغم أن رخص الجهات الملزمة تصدر منها وفروعها في المناطق . 6/ لم يتضمن نظام الحراسات الأمنية المدنية الخاصة ولائحته التنفيذية تحديد واضح لعقوبات عامل الحراسة المخالف ولبعض علاقاته مع صاحب العمل ، والجهات المستفيدة . أهم التوصيات : 1/ دعم إدارة الحراسات الأمنية المدنية الخاصة وشعبها في شرط المناطق بالإمكانيات البشرية والمادية اللازمة. 2/ إعادة النظر في دراسة تعديل بعض مواد نظام الحراسات الأمنية المدنية الخاصة ولائحتها التنفيذية لتشمل حقوق العاملين فيها من تحديد رواتبهم وإيجاد كادرهم الوظيفي ، ورعايتهم صحياً واجتماعياً ، وتحديد الحد الأدنى لرواتبهم . 3/ إعادة النظر في نظام الحراسات الأمنية المدنية الخاصة ولائحته التنفيذية لإيجاد دور فعال لوزارة البلدية والشئون القروية بهذا المجال . 4/ إعادة النظر في نظام الحراسات الأمنية المدنية الخاصة ولائحتها التنفيذية لتحديد فئات الجهات الملزمة فيها ، وتحديد ما يطبق من نظام العمل والتأمينات الاجتماعية كل على حده ، وتحديد عقود الحراسة وشروطها ، وعلاقات العاملين فيها مع الجهات المعنية ، وطرق التقاضي وتسوية الخلافات .
